| 'Rogue' trader freed without charge
FRENCH judges have placed rogue trader Jerome Kerviel under formal investigation but stopped short of charging him with fraud and have freed him from police custody. Shares in Societe Generale, where Mr Kerviel is alleged to have lost $8 billion, took a battering as allegations emerged that a board member was guilty of insider trading related to the scandal. Mr Kerviel was freed on bail after being placed under formal investigation for "breach of trust", "falsifying and using falsified documents," and "breaching IT procedures," said his lawyer Elisabeth Meyer. Judges rejected a bid to charge Mr Kerviel, accused by the French banking giant of losing €4.9bn ($8.23bn) with the more serious crimes of "gross breach of trust" and "attempted fraud".
All Eyes on Apple: A Clear-Eyed Analysis
This promises to be a joyous holiday season for Steve Jobs and the incandescent Apple (NASDAQ:AAPL). Over the past year, the company's numbers have been stunning: Sales are up 24%, earnings up 75%, margins topping 30%, stock price up 146%. The popularity of the iPod and its snazzy young cousin, the iPhone, has lifted other Apple products, helping boost market share in personal computers in the United States from 2% a few years ago to 8% this past quarter, with Apple leapfrogging Gateway to take third place behind Dell and Hewlett-Packard. The latest upgrade to Apple's operating system--Leopard--is getting strong reviews, in contrast to the indifference that greeted Microsoft's (NASDAQ:MSFT) new Vista OS. Apple's market cap is now north of $160 billion; 18 months ago, the crew in Cupertino, California, was worth a mere $60 billion.

The Big Bear Area Regional Wastewater Agency isn't taking any chances. The BBARWA board wants to test whether its treatment ponds have any leaks.BBARWA board member Rick Ollila became concerned when he requested information on the percolation rate of the wastewater in the ponds during the Oct. 24 strategic planning workshop. He couldn't get an immediate answer to the question, and wondered if there was any percolation into the aquifer that threatened wells used by the Big Bear City Community Services District, Ollila said.Ollila asked the BBARWA board to hold a special meeting to address percolation and whether BBARWA should line the ponds.BBARWA had the information on the percolation rates from a 1975 study done by Glen A. Brown and Associates. BBARWA General Manager Steve Schindler said finding the information wasn't easy because documents that old weren't stored on computer.

Suppose yourself a National Basketball Association lottery pick. Suppose further that you are blessed with a big body but are somewhat limited (Im being kind here!) in skills. Say your rookie year free throw percentage was a reeking 59%. That aint just malodorous that kind of stench from the line should trigger an OSHA investigation. The HAZMAT guys shouldve been sent in to clean up the site! Say further that you have no shot; you must be within 5 feet of the hoop to score. In plain talk: you cant hit the side of a barn with a Gatling gun even if you are inside the barn. If you were being paid kajillions of dollars, would you dedicate a few minutes each summer to honing those skills and your craft? If that question seems rhetorical, consider the career statistics of a certain overpaid NBA athlete.
